In February 2004, the department came out with a new tank closure and cleanup process that was called the Missouri Risk Based Corrective Action (MRBCA) guidance document for petroleum storage tanks. As the department implemented the guidance, it became clear that some parts of the guidance were not sufficiently clarified, that some were incorrect, and that new language was needed to address issues not addressed in the initial document. Therefore, in 2005, the department began the process of revising the guidance document, proceeding to a point at which a draft revision was largely complete. The draft revision was sent to over 200 stakeholders for comment. We received written comments from 10 stakeholders. The department was in the process of reviewing and addressing stakeholder comments when significant budget cuts forced the department to put a hold on the revision process.
In addition to the issues addressed by the revisions completed, the department has identified other existing guidance provisions that require revision, as well as new issues that the guidance does not address. The department intends to address all of these issues as we move forward with the revision process.
The department is committed to completing a comprehensive revision of the guidance and, thereafter, moving forward with the rulemaking process. The revision process will include looking back at the 2005 revisions and the comments we received regarding those revisions.
