Preliminary Action on Variance Request
City of Camdenton

The city of Camdenton has applied for a variance seeking relief from final effluent limitations and special condition D on Trichloroethylene, also known as TCE, contained in permit MO-0124389 for discharges from the “Mulberry Well”. The discharge consists of contaminated groundwater being pumped to prevent further contamination of municipal drinking water wells in the area and is a part of remedial activities under the federal “Superfund” program.

Staff recommended approval with the following conditions:

  1. The variance should set effluent limitations the city can meet pending implementation of the final remedial action approved by the Superfund program. Based on the data reviewed by department staff, a monthly average effluent limitation of 60 micrograms per liter and a daily maximum effluent limitation of 80 micrograms per liter are recommended.
  2. The variance should also eliminate Special Condition D in permit MO-0124389.
  3. Staff will be investigating termination of the permit when the Hazardous Waste Program approves the new treatment system, as the discharge will then be authorized as part of the remedial action approved by the Superfund program.
  4. The variance be approved until expiration or termination of the existing permit.

The Staff Recommendation was accepted and the Commission voted to direct the staff to public notice their intention to approve the variance with conditions.  The matter will be scheduled for final action at the March 12, 2008 Missouri Clean Water Commission meeting.

Comments should be confined to the issues relating to the proposed action and their effect on water quality.  The Missouri Department of Natural Resources may not consider as relevant comments or objects based on issues outside the authority of the Clean Water Commission.  See, Curdt v. Mo. Clean Water Commission, 586 S.W.2d 58 (Mo. App. 1979).

All water quality comments must be postmarked by Feb. 17, 2008 or received in our office by 5 p.m. on Feb. 20, 2008.  These comments will be considered in the formulation of all final determinations regarding the applications.  If response to this notice indicates significant public interest, a public meeting or hearing may be held after due notice for the purpose of receiving public comment on the proposed permits or determination.  Public hearings and/or issuance of the variance will be conducted or process according to 10 CSR 20-6.020.

The variance applications and supporting materials, as well as staff recommendations, are available for inspection and copying at the Department of Natural Resources, Division of Environmental Quality, Water Pollution Control Program, P.O. Box 176, 205 Jefferson Street, Jefferson City, MO 65102, between the hours of 8 a.m. and 5 p.m., Monday through Friday.
