Missouri Department of Natural Resources refers case against Hayti Heights to attorney general for enforcement action

JEFFERSON CITY, MO, MARCH 22, 2010—The Missouri Department of Natural Resources referred Hayti Heights to the Missouri Attorney General’s Office to pursue legal action against the city for violations of Missouri’s Safe Drinking Water Law and Missouri’s Clean Water Law.    

The department referred the case to the attorney general alleging numerous Safe Drinking Water Law and Clean Water Law violations occurred at Hayti Heights’ public drinking water utility and wastewater collection system.

The department is requesting the attorney general take necessary action to ensure Hayti Heights develops and implements department-approved remedies to bring the drinking water system and the wastewater collection system into compliance with the appropriate state laws. 

The department has documented more than a dozen Safe Drinking Water Law violations in Hayti Heights, including failure to use a certified drinking water operator; failure to properly maintain public water supply records; failure to perform necessary water quality monitoring; failure to maintain the required minimum water pressure and level of disinfection in the system; failure to notify the department and the public when disinfection levels fell below required minimums; and failure to collect or to remit the proper fees in 2005, 2006, 2007, 2008 and 2009.  

The department requires all public water systems to test for bacteria at least once a month to verify these systems are providing safe drinking water to the public.  While failing to monitor does not necessarily mean the water is unsafe, routine testing by a facility is a crucial part of maintaining a safe water supply. 

Hayti Heights owns and operates a wastewater collection system that transfers wastewater generated by homes in the city to the wastewater treatment facility in nearby Hayti.  Department staff documented Missouri Clean Water Law violations in Hayti Heights including failure to operate and maintain the wastewater collection system to comply with the Missouri Clean Water Law; and placing or permitting a water contaminant to be placed in a location where it is reasonably certain to pollute waters of the state.
