MISSOURI AIR CONSERVATION COMMISSION HOSTS

JEFFERSON CITY, MO, NOV. 29, 2006 -- The Missouri Air Conservation Commission will hold a public meeting at 9 a.m. on Dec. 7 at the Missouri Department of Natural Resources' Elm Street Conference Center, 1738 E. Elm St., Jefferson City.
At this meeting, the commission will hold a public hearing on several proposed rules, amendments and documents. Some proposed rules include 10 CSR 10-6.362, Clean Air Interstate Rule Annual Oxides of Nitrogen (NOx) Trading Program; and 10 CSR 10-6.364, Clean Air Interstate Rule Seasonal NOx Trading Program. These proposed rules would assist in the reduction of NOx emissions from electric generating units. Once established these rules will result in a 60 percent NOx reduction by 2015.
Other proposed rules include 10 CSR 10-6.368 Control of Mercury Emissions from Electric Generating Units; and 10 CSR 10-6.366, Clean Air Interstate Rule Sulfur Dioxide (SO2) Trading Program. When fully implemented, 10 CSR 10-6.368 will reduce utility emissions of mercury from 48 tons a year to 15 tons, a reduction of nearly 70 percent. 10 CSR 10-6.366 will allow for a 5 percent reduction in sulfur dioxide emissions by in 2015.
Proposed amendments include 10 CSR 10-6.350, Emission Limitations and Emissions Trading of NOx; and 10 CSR 10-6.360, Control of NOx Emissions from Electric Generating Units and Non-Electric Generating Boilers. These proposed amendments would remove the requirements of these rules upon implementation of proposed rule 10 CSR 10-6.362. The requirements of 10 CSR 10-6.362 are more stringent than these rules.
Another amendment, 10 CSR 10-6.062, Construction Permits by Rule will also be proposed. This proposed amendment addresses the concern that the rule as written does not provide a clear pre-construction review period. Language has been added to state that the department has seven days to do a pre-construction permit review.
The State of Missouri Plan for Implementation, Maintenance and Enforcement of National Ambient Air Quality Standards (NAAQS) will also be proposed to the commission. The purpose of this document is to provide an updated Missouri Plan incorporating the latest NAAQS as required by the Federal Clean Air Act.
Additionally, the commission will hear a recommendation for adoption of the Missouri State Implementation Plan -- St. Louis 8-Hour Ozone Nonattainment Area Reasonably Available Control Technology Demonstration.

Rule proposals considered at this hearing may be adopted by the Missouri Air Conservation Commission as provided for under authority of 643.050, RSMo.
