DEPARTMENT OF NATURAL RESOURCES ISSUES AIR VIOLATION TO RENEWABLE ENVIRONMENTAL SOLUTIONS IN CARTHAGE

JEFFERSON CITY, MO, DEC. 7, 2006 -- The Missouri Department of Natural Resources today issued a Notice of Violation (NOV) to Renewable Environmental Solutions (RES) in Carthage for excessive odors.

The department's Southwest Regional Office investigated a complaint received on Nov. 14 and documented the Notice of Excess Emissions (NOEE) coming from the facility.

RES was given time to respond to the department and provide information about a potential startup, shutdown or equipment malfunction. The department evaluated RES' response to the incident and determined the circumstances described did not meet the definition of a malfunction. As required by state regulations, the department has upgraded the NOEE to a NOV.

This is the seventh NOV issued to RES since March 2005. The state and RES reached a consent judgement in June that settled the previous six NOVs. As part of a consent judgement, RES paid $100,000 in civil penalties to the Jasper County School Fund. Another $75,000 was suspended and deferred unless, within two years from the signed consent judgement, RES received additional NOVs. The NOV issued today may require RES to pay a $25,000 fine that would ultimately go to the Jasper County School Fund.

The Department of Natural Resources' main goal in any enforcement action is to help the facility successfully achieve compliance with the standards and then maintain compliance. The department will continue to work within Missouri's laws and regulations to provide assistance and oversight to the facility. The department encourages citizens in the area to continue calling if they notice odors.
